The Supreme Court today made it clear that even if a person is guilty, his house cannot be demolished without following the procedure prescribed by law. On a petition against demolition proceedings, the Supreme Court asked whether someone's house can be demolished just because he is an accused. The Supreme Court further said that it will not protect any unauthorized construction. While fixing the hearing on the petition against demolition proceedings on September 17, the Supreme Court said that we propose to set guidelines for the entire country.
Most bulldozers are used in Uttar Pradesh. After Uttar Pradesh, bulldozers have been used in BJP ruled states. Now there is a possibility of a new guideline in this matter. Senior advocate Dushyant Dave, appearing on behalf of Jamiat Ulema-e-Hind, said that if the government assures that no bulldozer action will be taken in the name of justice, then the entire dispute can end.
The Supreme Court has also taken a tough stand in this matter. Justice Gavai questioned the action of the bulldozer. He said that how can someone's house be demolished just because he is an accused? Even if he is found guilty, his house cannot be demolished like this. Despite the earlier stand of the SC, we do not see any change in the attitude of the government.
Solicitor General Tushar Mehta said that the government had filed an affidavit on the issue in August 2022 and clarified that bulldozers cannot be run on someone's property just because he is an accused. This can be done only in violation of municipal laws. Notices were issued at the places where action was taken.
