Reservation is not possible on the basis of religion: SC

In a decision with far-reaching implications, the Supreme Court on Monday made it clear that reservation on the basis of religion is not possible. Justice B.R. A bench of Justices Gavai and KV Vishwanathan made the above observations in an oral opinion in relation to a petition challenging West Bengal’s categorization of Other Backward Classes (OBCs) into 77 different communities.

Earlier this classification of West Bengal was rejected by the Calcutta High Court which was challenged by the West Bengal Government. Most of the Muslim community was included in this classification. Advocate Kapil Sibal, appearing for the West Bengal government, argued that this year and thereafter the state government cannot do anything on the issue of reservation because there is no reservation in admission, no reservation in employment, no reservation in promotion and scholarship. . Praising the decision of the High Court, he said that whatever reservation was given was given to the backward sections of the community and not on the basis of religion. He appealed to the bench to pass an interim order on this issue. The court will hear further on this issue on January 7, 2025.
