Arvind Kejriwal CM post controversy: Delhi High Court has rejected the petition demanding removal of Arvind Kejriwal from the post of Chief Minister. The High Court has said that if there is any kind of constitutional crisis then the President or LG will take the decision, the High Court will not interfere in that matter.

A petition was filed to remove Arvind Kejriwal from the post of Chief Minister.

Five days ago, Vishnu Gupta, president of an organization called Hindu Sena, had filed a petition demanding the removal of Arvind Kejriwal from the post of Chief Minister, but the High Court has refused to hear this petition. The division bench of Acting Chief Justice Manmohan Singh and Justice Manmeet Pritam Singh Arora gave the verdict in this case.

High Court replied

Vishnu Gupta said in his petition, 'Kejriwal is an accused in Delhi liquor scam and money laundering case. Therefore, he has no right to hold a constitutional post. The High Court refused to consider his PIL on this matter and said that it is Arvind Kejriwal's personal decision whether he wants to remain the Chief Minister or not.

High Court cannot take any decision on this issue

The High Court cannot take any decision on this issue, because the power to take the decision rests with the Lieutenant Governor (LG) of Delhi or the President of the country. If Kejriwal wants to remain on the post of Chief Minister, he can remain so. The High Court will not interfere in this matter.

LG does not need High Court's advice or guidance

According to media reports, the High Court said, 'How can we say that the government is not working? The LG is competent to decide on his tenure as Chief Minister. In this matter, LG does not need the advice or guidance of the High Court. They have power. Whatever he has to do, he will do it according to the law. Therefore, the petitioners should contact the concerned people and not come to the High Court. After this the applicant withdrew his application.

What is the matter?

The Enforcement Directorate (ED) has arrested Arvind Kejriwal in the Delhi liquor scam. After his arrest on March 21, he was taken on remand twice. After this, on April 1, he was sent to Tihar Jail for 14 days judicial custody. He is fulfilling the responsibility of the post of Chief Minister from jail itself.
