The Karnataka High Court quashed a criminal case registered by the police against two persons for allegedly raising Jai Shri Ram slogans inside a mosque. The court said it was unable to understand how raising slogans of Jai Shri Ram could hurt the religious sentiments of any community. A bench headed by Justice M Nagaprasanna reviewed the plea of the accused and in its judgment said it was not clear how raising the slogan of Jai Shri Ram could hurt the religious sentiments of any community.
The accused were charged under section 295A of the IPC for allegedly raising slogans of Jai Shri Ram in the mosque. A case was also registered against him under sections 447, 505, 506 and 34 of the IPC. The accused approached the High Court to quash the charges against them.
The accused's lawyer argued that the mosque is a public place. Therefore no such issue arises there. The Karnataka government had opposed the petitioners' plea and sought their custody, saying the case required further investigation.
The court will not allow the proceedings to proceed.
Bar and Bench quoted the court as saying that the complainant had said that Hindus and Muslims live peacefully in that area. The bench also said that it would be an abuse of the process of law if it allowed the proceedings against the petitioners to proceed. Citing the Supreme Court order, a bench headed by M Nagaprasanna said that no act would constitute an offense under Section 295A of the IPC.

Police alleged that the accused entered the mosque at around 10:50 am on September 24, 2023 and raised slogans of Jai Shri Ram. He is also accused of threatening. When the complaint was filed, the accused were identified as unidentified persons and the accused were later taken into custody. In response to these allegations, the accused approached the Karnataka High Court and filed a petition. Later the court dismissed the case against him.
