Ranchi, 07 September (HS). The hearing in the comment case against the then national president of BJP Amit Shah was held in the court of MP-MLA Special Judge Sarthak Sharma on Saturday. The petition seeking personal exemption from appearance of Rahul Gandhi in the case was heard. The lawyer on behalf of Rahul Gandhi sought time from the court to respond. On this, the court granted time and fixed the date of next hearing on 21 September.
Earlier, a reply was filed on August 31 on behalf of complainant Naveen Jha's lawyer Vinod Sahu. The lawyer said that Rahul Gandhi wants exemption from personal appearance in the case. Regarding this, his lawyer Pradeep Chandra has filed a petition under section 205 of CrPC on August 14. Rahul Gandhi has to appear in court in the case. Summons have been issued regarding the appearance. On this, the complainant's lawyer had requested to issue an arrest warrant against Rahul Gandhi, but the hearing is pending as the service report of the summons has not been received by the court.
The court had earlier issued summons to Rahul Gandhi and asked him to appear in person. The summons issued by the MP-MLA court earlier was challenged by Rahul Gandhi in the High Court, which was rejected by the High Court. After this, the MP-MLA court again issued summons to Rahul Gandhi.
It is noteworthy that Ranchi Civil Court had issued summons to Rahul Gandhi for the first time after the complaint was filed in the case in the year 2018. This complaint was filed by BJP worker Naveen Jha in the year 2018. It has been said in the petition that the then National President of Congress Rahul Gandhi had made objectionable remarks against the then National President of BJP Amit Shah in the convention held in Delhi.
According to Naveen Jha, during this time Rahul had said that a murderer can become the president in BJP but this cannot happen in Congress. He was hurt by this statement. The image of the party has been tarnished. This is why he filed a complaint.
