The news of a huge and historic legal victory has come out from Pune, Maharashtra, which has provided justice to the victim in the ‘Nasrapur minor girl rape and murder case’ that has shocked the entire country. The special POCSO court of Pune has sentenced 65-year-old elderly accused Bhimrao Prabhakar Kamble to death by inhumanely brutalizing and murdering a three-and-a-half year old innocent girl. Considering the cruelty, obscenity and barbarity of this dreadful crime, the court placed it in the category of ‘rarest of rare’ cases and considered the criminal a big stigma for the society.
Special government lawyer Advocate Ajay Misar and victim’s lawyer Advocate Vipul Dashing confirmed this historic decision in a live conversation with the media outside the court. The lawyers said in very strong words that there is no place for such monsters in the society. The accused took the life of an innocent girl just to satisfy his lust, hence the court has ordered him to be put to death if the crime is proved beyond any doubt.
Justice provided within 55 days: Fast-track court created history
Special government lawyer Advocate Ajay Misar said that the decision of this very sensitive and heart-wrenching case has been completed in record time. The death sentence awarded to the accused within just 55 days of the crime is an example in the Indian justice system. Due to the prompt investigation by the police, the solid charge sheet filed within just 15 days and the continuous hearings of the fast-track court, the victim has been able to get justice very quickly. This decision will create a strong fear in the minds of such despicable criminals in the society.
While giving the verdict, the court made special comments on the age difference and the nature of the crime. At the time of the incident, the victim was only 3 years, 2 months and 7 days old, while the accused who committed the crime was a 65-year-old man. This age gap and the brutality of the crime itself speak volumes about how cruel and inhuman this act was.
The animal was taken to the cowshed on the pretext of showing the calf: 39 minutes of cruelty
This horrific incident took place on May 1 in Bhor (Nasrapur) area of Pune. The victim innocent girl had come to her grandmother’s house to spend her summer holidays. In the afternoon, when she was playing outside the house, accused Bhimrao Kamble lured her by showing her a newborn calf and giving her food items. The innocent girl agreed with his words, after which the accused took her to a nearby deserted cow shed. There he committed inhuman and naturally very cruel sexual assault (rape) on the innocent child for about 39 minutes. After this, fearing being caught, he brutally murdered the girl by pressing her mouth and hid the body there.
Postmortem report and forensic evidence exposed the murderer’s lies.
When the girl’s body was found on the night of 1 May, there was outrage across Maharashtra. Angry villagers blocked the Pune-Bengaluru highway for several hours, after which the government gave a written assurance that the case would be tried in a fast-track court and a special PP would be appointed.
In the post mortem report, 18 serious injury marks were found on the body of the innocent girl, which shows the gruesomeness of this crime. However, to save himself in court, the vicious accused had fabricated a false story that the girl had suffered injuries due to her feet slipping, but scientific and forensic evidence proved his lie. The accused was completely exposed in front of the CCTV footage presented by the police, DNA Profiling, evidence found at the spot and testimony of eyewitness children.
There is no scope for improvement: the accused has been an old criminal
The government lawyer, citing 12 historical decisions of the Supreme Court, argued in the court that this 65-year-old accused is a serious threat to the society. Investigation revealed that he also had an old criminal record, which included allegations of misbehavior with a 62-year-old woman and a 17-year-old girl. The court accepted that there was no remorse on the face of this cruel accused for his actions and there was no scope left for improvement, therefore, for the safety of the society and dignity of justice, hanging is the only right punishment.
