Principal Secretary of Consumer Affairs ordered to appear in the High Court

Taking serious note of the long pending process of not starting the recruitment process for the vacant posts of Chairman and members in the State Consumer Commission and District Consumer Commission and not filing the affidavit as per the order of the Division Bench of Rajasthan High Court, Chief Justice Manindra Mohan Srivastava and senior judges Shri Chandrashekhar has ordered the Principal Secretary of the State Food, Civil Supplies and Consumer Affairs to appear before the court on Wednesday with complete records.

While arguing the PIL filed on behalf of Rajasthan High Court Advocates Association, advocates Anil Bhandari and Ratnaram Tholiya said that 54 posts of Chairman and members are vacant in the District Commissions and State Commission of the state for the last one and a half to two years and the Consumer Protection Act 2019 There is a mandatory provision in Rule 6 of the Consumer Commission that the State Government will declare the vacancies 6 months before the vacancies in the Consumer Commission so that the entire recruitment process can be completed before the vacancies and the objective of speedy justice of the Consumer Act can be maintained. He said that the division bench issued orders continuously from February to October and ordered the state government to file an affidavit and inform about the status of the recruitment process of chairpersons and members in the State Consumer Commission and District Consumer Commissions in the state, but in the consumer case, has neither provided any affidavit nor factual information about recruitment on this. He said that due to this the judicial proceedings have been completely disrupted. Chief Justice of the Division Bench Manindra Mohan Srivastava and Senior Justice Shri Chandrashekhar ordered the Principal Secretary, Food, Civil Supplies and Consumer Affairs of the state to appear with complete records on Wednesday for not following the order of the Division Bench dated October 15.

After this, the Director of the State Consumer Affairs Department, keeping in mind the vacancies till the coming March, appointed 21 chairpersons including 3 judicial members and 4 non-judicial members in the State Consumer Commission and 2 chairpersons of both the District Consumer Commissions of Jodhpur and four members in Jodhpur. Declaring vacancies for 59 members, online applications have been invited from 26th November to 16th December.
