Prayagraj, 08 March (HS). Allahabad High Court has canceled the punishment given by the Chairman to stop one increment to Sanjay Kumar, the Executive Engineer posted in Electricity Corporation, Varanasi, for negligence in performing his duty.
The court said that this order has been given without examining the witnesses and evidence, hence it is not maintainable. The court has given the petitioner a chance to clarify his testimony in the departmental inquiry committee and has directed the chairman to pass a fresh order as per the rules and has said that if the petitioner is found guilty, he should not be given more punishment than the previous order.
Justice JJ Munir has given this order while accepting the petition of Sanjay Kumar. It is known that the petitioner is posted in Varanasi. When he was in Noida from July 19 to January 21, he was given a charge sheet in the departmental investigation proceedings. It was alleged that the electricity connection register was not maintained and proper action was not taken on the recovery of crusher connection dues in Shahpur Kala. He was found guilty of negligence and punished by the chairman. Which was challenged saying that no opportunity was given for clarification and testimony before being punished.
