Jaipur, March 28 (HS). The Rajasthan High Court has expressed displeasure over the state government not submitting its reply even in four years in the matter related to the unemployed. Along with this, the court has sent a copy of the order to the Governor, Chief Secretary and Principal Law Secretary. The court said that the matter should be brought to the notice of the Governor, so that the interests of the state government can be protected during the litigation. Along with this, the court has given time till April 3 to the state government to submit its reply on the condition of compensation of ten thousand rupees. A single bench of Justice Ganesh Ram Meena gave this order while hearing the petition filed by Rekha Kumari and others.
The court said in its order that a notice in the case was served in the office of the Additional Advocate General of the state government on January 22, 2020. The Additional Advocate General sought time to submit the reply from time to time. Even after four years, the state government is still asking for time to submit its reply. The court said that the matter is related to appointment to the post of third class special teacher. The petitioner is unemployed and has come to the High Court for justice. The state government, which is said to be a public welfare state, has been seeking time to submit its reply for the last four years. This attitude of the government cannot be called public welfare under any circumstances. Due to such laxity of the government, the justice system is failing and the unemployed have to come to the courts.
No effective advocacy since last two months
The court said that it has been seen that for the last two months, government lawyers and officials are not providing adequate representation. The court has also summoned the Chief Secretary and Principal Law Secretary in the past, but till now no satisfactory arrangement has been made. Many times the hearing had to be postponed due to non-availability of the government lawyer. Apart from this, on many occasions the government itself did not appear in the petition presented by the state government.
