Rajasthan minister Rajyavardhan Singh Rathore on Monday attacked police officers at Jaipur's Shipra Path police station over the alleged stripping of a serving Indian Army jawan. After the case came to light, a police sub-inspector and three constables have been removed from the police station and sent to the police line and an inquiry has been ordered. Sainik Welfare Minister Rathore has also served in the army. In this case, he reached the police station and got into an altercation with the police officers present there.
Can the police arrest an army soldier?
The job of the police is to keep people safe, but many times police officers have been seen breaking the law. After the Jaipur incident, the question is now being raised whether the police has the right to arrest an army soldier? So the answer is yes and no… both. There are different rules for that. Actually, both the army and the police are different government departments and have their own scope and responsibilities. Both the police and the army have their own legal procedures and they follow specific arrest rules and guidelines within their jurisdiction.
When can the police arrest?
According to the SSB Crack Exam report, this is mentioned in Section 70 of the Army Act 1950 and Section 72 of the Air Force Act. According to the rules, army personnel can be arrested only in cases of major crimes like murder, rape or kidnapping. The police has to take permission from the central government for arrest in a heinous crime or any other case. Along with this, handcuffing any army personnel is also not allowed.
According to the rules, no military officer can be kept in the police station for more than 2 hours after arrest. Then he will have to inform the nearest military headquarters and take permission from the army officers for further action. This permission will be given by the station commander of the rank of Major General or above. If permission is not granted, the soldier will have to be handed over to the military police. Apart from this, the police can interrogate army personnel only in civil matters. If both the parties involved in the crime are in the army, then the matter will go to the military court.

Policemen of Jaipur's Shipra Path police station raided a hookah bar and arrested some people. An army soldier was also involved in this. Another soldier Arvind Singh posted in Baramulla, Jammu and Kashmir was beaten up when he reached Shiprapath police station to inquire about the arrest of the soldier. On getting information about this matter, Sainik Welfare Minister Rajyavardhan Singh Rathore reached the police station and reprimanded the ACP.
Speaking to reporters, Rajyavardhan Singh Rathore said that a serving soldier was stripped and beaten by some policemen and then made to sit in the crowd when some policemen asked him to repeat that the police is the 'father' of the Indian Army. He said that this is extremely sad and it reflects the poor mentality of the two-three people who did this. The minister said that the soldier has been badly beaten and this will not be tolerated. He said that the medical report states that people beat him up. An Indian Army soldier has been caught and killed by five policemen. That too without any law or reason. Therefore, action is necessary against those who break the law in the police department.
