The police have added such a law to the investigation of this case, hearing the name of which even big criminals lose their sleep. The name of this law is UAPA (Unlawful Activities Prevention Act). Now you must be wondering what is this UAPA and why did the police use it? Let us understand in very simple language.
What is this UAPA law?
Simply put, UAPA is a very strict law made to prevent terrorism and curb its related activities. When there is suspicion of a threat to the security of the country or a terrorist conspiracy behind any incident, then the investigating agencies use this law. This law gives some special powers to the police and investigative agencies, which are not available in general laws.
Why is it so dangerous?
- Provision for strict punishment: If found guilty under this law, the punishment can range from life imprisonment to death.
- Difficult to get bail: If someone is arrested under UAPA, it becomes almost impossible for him to get bail. The police also gets up to 180 days to file the charge sheet, whereas in normal cases it is 60 to 90 days.
- More power to agencies: This law gives a lot of power to agencies like NIA (National Investigation Agency). They can go to any state, investigate and even seize property, for which they do not need prior permission from the police of that state.
Why was UAPA invoked in Delhi blasts?
During the investigation of the car which was used in the blast near the Red Fort, the police have found material for making explosives. Whenever a bomb or explosive is used in an incident and there is suspicion of a terrorist conspiracy behind it, the police almost always register a case under UAPA. Imposition of this law means that the police is investigating this incident as a terrorist attack and wants to destroy the entire network behind it.
