The matter of appointment of Chief Election Commissioner (CEC) and Election Commissioners (EC) has reached the Supreme Court. A petition has been filed in the court demanding to stop the government from appointing CEC and EC under the new provisions. Also, in the petition, a demand has been made to give instructions for the appointment of the members of the Election Commission as per the decision of the Constitutional Bench of the Supreme Court. The sudden resignation of Election Commissioner Arun Goyal has become a topic of discussion across the country. A case challenging the Centre's new law on the appointment of the Chief Election Commissioner and Election Commissioners is pending in the Supreme Court. Two new election commissioners are likely to be appointed on March 15. Depending on the availability of members, the selection committee will meet on March 13 or 14. A committee headed by Union Law Minister Ram Meghwal, including Cabinet Secretaries of the Home Department and the Department of Personnel and Training, will prepare two separate panels of five names each for each post. A selection committee headed by Prime Minister Modi, including a Union minister and Leader of Opposition in the Lok Sabha Adhir Ranjan Chowdhury, will shortlist the names of two individuals as Election Commissioners before they are officially appointed by the President.
Supreme Court refused to ban the new law
On February 13, the Supreme Court again refused to ban the new law on the appointment of CEC and EC. However, a notice was sent to the Center regarding the fresh application and response was sought and the matter was merged with the earlier pending cases. The petition was filed by the Association for Democratic Reforms (ADR).
