Prayagraj, August 20 (HS). Allahabad High Court has rejected the public interest litigation filed against the construction of chambers and parking for lawyers in the High Court premises.
The court has also reprimanded the petitioner lawyers for filing a frivolous petition. The court imposed a fine of Rs 40,000 on the petitioners, but waived it after they apologized. The court said that filing frivolous PILs to put undue pressure on contractors and builders has become a trend.
A division bench of Justice Mahesh Chandra Tripathi and Justice Prashant Kumar heard the PIL filed by Santosh Kumar Pandey. The petition said that L&T Company has excavated the soil without taking permission from the mining department and without environmental clearance certificate. At the same time, the state's lawyer told the court that an online application was made on 25 October 2021 for digging the soil, which has been approved. The project has already received approval from the mining department and also has an environmental clearance certificate. The soil was excavated only after approval. The court was also told that the lawyer representing the present petitioner himself had filed a similar petition in 2022, which was rejected.
The court said that the present PIL was filed in December 2022, two months after the dismissal of the previous PIL. The previous petition was filed by Aditya Singh, who is the lawyer in this petition.
The court said that filing another petition with the same relief while hiding the facts is an abuse of the process of law. The conduct of the petitioner is not correct and he has not come to this court with clean hands. The petition has been filed at someone's behest, so that the construction of chambers and parking for lawyers can be stopped. The court dismissed the petition.
