Parole to Falahari Baba, who is serving life sentence for raping a disciple

Jaipur, 26 April (HS). The Rajasthan High Court has ordered the release of Falahari Baba, who is serving life imprisonment for raping a disciple in his ashram in Alwar, on regular parole for twenty days. The division bench of Justice Inderjit Singh and Justice Ashutosh Kumar gave this order while accepting the parole petition of Kaushalendra Prapannacharya alias Falahari. The court has also canceled the order of the Parole Committee of January 29, in which the committee had recommended not to grant parole to the accused Baba. The court said in its order that the accused has been in jail for seven years. In such a situation, he is entitled to take parole under the parole rules. Apart from this, his conduct in jail has also been found satisfactory. Therefore it is appropriate that he be released on parole.

In the petition, advocate Vishram Prajapati told the court that the petitioner has been in jail for a period of more than seven years. In such a situation, he is eligible for the first regular parole of twenty days, but due to the contrary report of the Superintendent of Police, the Parole Committee rejected his parole application. Whereas the report of the Jail Superintendent of the Central Jail and the Social Justice Department regarding the petitioner is satisfactory. Opposing this, the state government said that the Superintendent of Police has given a report against the petitioner. Apart from this, he is serving a sentence for a serious crime. If he is released on parole, it will have an impact on the society and the victim. After hearing the arguments of both the parties, the court has ordered the release of the accused petitioner on regular parole for twenty days. It is noteworthy that a 21-year-old law student had lodged an FIR in September 2017. In which it was said that the accused had raped her in the ashram located in Alwar on August 7, 2017. In the case, on September 26, 2018, the ADJ Court had sentenced the accused to life imprisonment.
