Order to the board to release the canceled marksheet of the canceled 12th re-examination

Mumbai: After re-examination of class 12th, the state board canceled the marksheet due to not receiving it on time. However, now the Goregaon student has refused to give the marksheet after knocking at the court's door, after which the court has ordered the board to give a new marksheet to this medical student. The court's order has cleared the way for the student's further studies.

The bench of Justice Chandurkar and Justice Jitendra Jain said that in order to get the opportunity of higher education, many students, who have less marks, re-examine and get more marks, in such a situation, the decision is being taken to cancel the marksheet without any provision. Irrational.

A class 12 student took the board exam again in 2018 to improve his marks. It is mandatory to carry the mark sheet within six months after the examination. But he did not take it. The result was that the board canceled his mark sheet. The bench directed the education board to provide the marksheet with the fresh marks of the petitioner. At that time, the petitioner student was also ordered to submit the old marksheet to the board and pay the late fee.

This student had given the 12th class board examination in February 2017. In this he had 55.37 percent marks. But to qualify the NEET exam for medical entrance, he took the exam again and scored 65.2 percent. After this he prepared for NEET and took admission in a coaching class in Kota. He took that exam several times. Meanwhile, when she applied to the board for revised marksheet in 2022, the board approached the court when it did not receive the marksheet within six months and refused to give it. Because in this the court noted the reasonable explanation for the delay in getting the mark sheet to the student. On the basis of which it is appropriate for the student to get the mark sheet.
