The High Court has canceled the order issued on July 4, 2023 by the Agriculture Secretary to forcibly retire the professors who have completed 60 years of service working in the research project in Pantnagar University by considering them as non-teachers and ordered to reinstate them and give them all the benefits. Have given. Earlier, the High Court had also accepted the petition of professors working in the posts of Senior Statistician/Senior Research Officer.
The case was heard before the division bench of Senior Justice Manoj Kumar Tiwari and Justice Pankaj Purohit. According to the case, Deepa Vinay and others challenged in the High Court the order given by the State Government and Pantnagar University Administration to consider the petitioners as non-teachers and retire them at the age of 60, saying that they were appointed in the Indian Council of Agricultural Research. And now he has been promoted to the post of Professor. The state government has increased the retirement age of professors to 65 years in 2013. The government issued an order in 2023 considering him a non-teacher and retired him at the age of 60. Whereas he has been appointed as a teacher as per the University Acts and UGC rules. After hearing all the parties in this case, the court accepted that the petitioner is a university teacher and he was given all the benefits of a teacher. After which the court canceled the order of the government and the university and asked the Pantnagar University administration to immediately reinstate the petitioners with all the benefits.
