Order acquitting Gautam Gambhir in the case of fraud with flat buyers canceled

New Delhi, 30 October (Hindustan Reporter). The Sessions Court of Delhi's Rouse Avenue Court has set aside the Magistrate Court's order acquitting former cricketer and former BJP MP Gautam Gambhir of charges of defrauding flat buyers of real estate company Rudra Buildwell Reality Private Limited. Special Judge Vishal Gogane sent the case back to the Magistrate Court and directed that it should issue a fresh order on framing of charges against Gautam Gambhir, which would have detailed information about the allegations of each accused related to this case.

On December 10, 2020, the Magistrate Court of Rouse Avenue Court had acquitted Gautam Gambhir in this case of the charges of defrauding the flat buyers of real estate company Rudra Buildwell Reality Private Limited. When this case was going on in the Magistrate Court, Gautam Gambhir was an MP, due to which the hearing on this case was going on in Rouse Avenue Court. In the case, Delhi Police had filed a charge sheet against Gautam Gambhir in Saket Court in September 2019. Gautam Gambhir was the brand ambassador of real estate company Rudra Buildwell Reality Private Limited and there were allegations against the company of defrauding flat holders. Apart from Gautam Gambhir, Delhi Police had accused company promoters Mukesh Khurana, Gautam Mehra and Babita Khurana. A case was registered against Gautam Gambhir under sections 406 and 420 of the Indian Penal Code.

The company is accused of committing fraud by taking money from flat holders. The Economic Offenses Wing filed a case on the complaint of the flat holders. It has been alleged in the petition that the company took money from investors by cashing in the name of Gautam Gambhir and did not give flats. The flat buyers have complained alleging that they had booked flats in a real estate project of the company in Indirapuram, Ghaziabad in 2011, but did not receive the flats. The charge sheet of Delhi Police states that even after promising to hand over the flats to the buyers on June 6, 2013, the company kept procrastinating till 2014. On April 15, 2015, the authorities canceled the project's approval.
