The Supreme Court has given a big decision regarding reservation. The country's highest court has cancelled the decision of the Madhya Pradesh High Court, in which it had ordered not to give admission to the meritorious students taking advantage of reservation on general category seats. The Supreme Court said in its decision that if the meritorious students of Other Backward Classes (OBC), Scheduled Castes (SC) and Scheduled Tribes (ST) categories are entitled to get admission on general quota seats on the basis of their merit, then admission should not be given on the seats.

A bench of Justices BR Gavai and KV Vishwanathan gave this verdict while accepting the appeal filed by Ram Naresh alias Rinku Kushwaha and others against the decision of the Madhya Pradesh High Court. The bench said that if the students of OBC, SC and ST category are entitled to get admission in unreserved i.e. general category on the basis of their merit, then they should get admission only on unreserved seats.

The old case was handed over

The Supreme Court relied on its earlier judgment in the case of State of Uttar Pradesh vs Saurav Yadav and others. The case pertains to MBBS admissions in a medical college in Madhya Pradesh where meritorious students from reserved categories were denied admission under the general quota.

What is the whole matter?

Let us tell you that this matter is related to admission to MBBS seats in Madhya Pradesh. Out of the total seats, 5% were reserved for government school (GS) students. According to Rule 2 (G) of Madhya Pradesh Education Admission Rules 2018, many seats have remained vacant. The seats have been shifted from GS-UR category to Open category.

The petition prayed that meritorious reserved category students studying in government schools should be given admission in MBBS under the government school quota for the non-reserved category. The petitioners had filed a petition in the High Court against the fact that meritorious students passing out from government schools were not being given admission in general seats of MBBS. Here their application was rejected. However, the Supreme Court has ruled in their favor.
