The Central Government has taken a new decision for those who dream of becoming parents through surrogacy. In its new decision, the Central government has amended the Surrogacy Rules, 2022 to allow the use of eggs and sperm from donor gametes. With this condition, one of the couple has a medical condition that causes them to be unable to use their partners. The Surrogacy Research Rules 2024 announced by the government state that the District Medical Board will have to certify that one of the spouses is suffering from such a condition.

What does the law say?

It further states that the approval of surrogacy using donor gametes is subject to the condition that the child born through surrogacy must have at least one gamete from the intended pair. Single women undergoing surrogacy must use their own eggs or donor sperm to benefit from the surrogacy process.

What was the provision in the previous law?

In March 2023, a notification issued by the Central Government banned donor gametes for couples seeking surrogacy, following which a petition was filed seeking relief from the court. In these applications, on the basis of medical reports, it was shown that they were incapable of producing eggs. The notification said that intending single mothers also cannot use the eggs of donor mothers. After receiving several petitions, the Supreme Court asked the government to reconsider the 2023 notification.
