New Delhi: Delhi High Court has given an important verdict on the issue of blaming the other party for ending life due to failure in love. The bench of Justice Amit Mahajan said that if the lover commits suicide due to failure in the love relationship, then the woman cannot be held guilty of instigating the man to commit suicide.
The court also said that a wrong decision taken by a weak or feeble-minded person cannot be held guilty of abetment of suicide by another person.
The woman has got bail
The court made the above observation while granting anticipatory bail to a woman and a man accused in a case of abetment of suicide. The father of the man who committed suicide had filed a complaint saying that the woman was in love with his son, while the other applicant was a mutual friend.
there was talk of marriage
It was alleged that the applicants provoked the deceased by saying that they had physical relations with each other and would soon marry. The person had committed suicide and a suicide note was also recovered from him. In this, the deceased had told both the applicants as the reason for suicide.
Young man threatened to commit suicide
The court, while granting anticipatory bail to the applicants, said that prima facie it appears from the WhatsApp chats on record that the deceased was of sensitive nature and whenever the woman refused to talk to him, he would continuously threaten to commit suicide.
The bench said that it was true that the deceased had written the names of the applicants in the suicide note, but in the opinion of the court nothing about the nature of threats was mentioned in the suicide note written by the deceased.
The court said that prima facie the suicide note only expressed the pain of the deceased towards the applicant, but it cannot be inferred that the applicant had any intention due to which the deceased committed suicide.
