No scope for judicial intervention, Delhi HC rejects petition against Kejriwal's CM post

Delhi High Court has rejected the petition to remove Vind Kejriwal from the post of CM. The court said that there is no scope for judicial intervention in this matter. If there is any constitutional failure then the Lieutenant Governor should look into it. It is noteworthy that petitioner Surjeet Singh Yadav had expressed concern in the court that Arvind Kejriwal is running the government from jail.

A bench headed by Acting Chief Justice Manmohan said that the court said that we understand that there may be some practical difficulties. Why should any order be passed? We do not have to give any guidance to the President or LG. The executive branch enforces President's rule and it is not the job of the courts to guide them.

Who filed the application?

It is noteworthy that a person named Surjeet Yadav had filed a PIL in the Delhi High Court saying that Chief Minister Arvind Kejriwal was arrested on March 21 in the excise case. He is in ED custody since March 22. In such a situation, he should be removed from the post of Chief Minister. Let us tell you that Surjeet Yadav had also filed another PIL demanding ED custody to stop Arvind Kejriwal from giving instructions to the ministers.
