Rajasthan High Court News: Government employees in Rajasthan who have more than two children will not get promotion, the High Court has issued an order in this regard. This order of the High Court has come against the decision of the state government in which the government was giving promotion to the state employees with retrospective effect. The High Court has put an interim stay on this order of the state government.
In this case, answers have been sought from the Personnel Department, Principal Secretary of Home Department, Director General of Police and others. The court has also sought information from the government about the impact of this court order on the employees of about 125 departments.
The High Court's division bench of Justice Pankaj Bhandari and Justice Vinod Kumar Parwani gave this order while hearing the petition of policemen Santosh Kumar and Jaideep. Petitioner's lawyer Shobhit Tiwari, appearing in the court, said that the state government does not give 3rd and 5th promotions to those government employees who have two or more children on or after 1 June 2002.
After this, on March 16, 2023, the Personnel Department issued a notification before the assembly elections and sought relief, stating that an employee cannot be denied promotion just on the basis of having more children, it is the government's right to amend the rules but the procedure adopted is not appropriate, hence the government's order will be stayed till the next hearing. In the petition filed in the court, it was demanded that retrospective promotion is not valid. The court has passed an order and put a stay on the government's notification. Along with this, a reply has also been sought from the government.
