Prayagraj, 27 September (HS). The Allahabad High Court has said that a person cannot be kept in jail indefinitely if the prosecution is not interested in producing witnesses and completing the trial.
Expressing displeasure over the prosecution not presenting witnesses and evidence on time even in serious crimes, the court has sought a personal affidavit from DGP UP. He has been asked why the prosecution in serious crimes does not produce witnesses on time. The court asked what steps he has taken in this direction as the head of the police department. Have they fixed the responsibility of the guilty police officer or person in any case?
While hearing the bail application of Manoj of Etah, Justice Sanjay Kumar Singh has also sought a report from the concerned presiding officer. In which he has asked to give information about the process that has taken place so far in the trial of the case. It should also be told why the trial could not be completed and who is responsible for it.
Advocate of petitioner Manoj said that this is his fourth bail application. Before this, three of his bail applications have been rejected. The petitioner is in jail since 2017. The advocate said that in the last seven and a half years, the prosecution has presented only three witnesses and there is no hope of completing the trial in the near future. Which is a violation of the guidelines issued by the Supreme Court. On this, the court said that it is continuously being seen that even in serious cases, the prosecution does not present the witnesses on time. Due to which the trial of all the cases is pending. A person cannot be kept in jail indefinitely if the prosecution is not interested in producing witnesses and completing the trial. The court has directed the DGP and the presiding officer to submit their reply before passing any order on the bail application.
