CJI DY Chandrachud's anger at the petitioner: Expressing displeasure over the petition demanding investigation against former CJI of India Ranjan Gogoi, the Supreme Court has reprimanded the petitioner. On Tuesday, Chief Justice D.Y. When Chandrachud's bench sat to hear the case again, it got enraged after hearing the allegations made by the petitioner against the former CJI. While rejecting the petition, the court told the petitioner that there is no merit in his petition. The petitioner started the debate on this. After this the court ordered the security personnel to take him out of the court room.
Petitioner demands investigation against former CJI Ranjan Gogoi
Arun Ramchandra Hublikar filed a petition in the Supreme Court against his illegal dismissal from service. In this he told the court that I had earlier also filed a petition on service dispute, at that time former CJI Ranjan Gogoi had rejected my petition. Arun Ramchandra Hublikar has demanded an investigation against the former CJI. On September 30, a bench headed by CJI Chandrachud had expressed strong objection to the petition seeking investigation against former CJI Ranjan Gogoi and asked the petitioner to remove his name from the list of parties.
There is no strength in your application
Along with CJI Chandrachud, Justice Bela M Trivedi and Justice Satish Chandra Sharma were also present in the hearing. He ordered the security personnel to take Hublikar out of the court room. During the hearing on Tuesday, the bench got angry when the petitioner took the name of the former CJI. The bench said, we are going to impose fine on you. Do not take the name of any judge. There is no strength in your application.
How come there is no merit in my petition…
The petitioner started a debate on this issue with CJI Chandrachud and both the judges. He objected to the bench's remarks and said, “How can you say that my case has no merit?” How can this be said, this is injustice against me. At least I should get justice before I die. On this the bench said that we have rejected the petition, then ordered the security personnel to take the petitioner out of the court room.
A little dignity…
In the last hearing, CJI Chandrachud had put a condition before the petitioner to remove the name of the former CJI from the list of parties. The bench said, how can you file a petition by making a judge a respondent? Some dignity should remain. You cannot say that I want an internal inquiry against the judge. Justice Ranjan Gogoi was a former Supreme Court judge. The court said, 'Justice Gogoi retired from the post of Chief Justice of India. You cannot say that I want an internal inquiry against the judge, because you have not been successful in getting your arguments across before his bench. Sorry, we can't afford it. After Hublikar assured to remove the former CJI's name from the list of parties, Justice Chandrachud ordered listing of the petition, which came up for hearing on Tuesday. Justice Gogoi retired on 17 November 2019.
