New Delhi, 02 July (HS). A petition has been filed in the Delhi High Court challenging the election of Lok Janshakti Party (Ram Vilas) MP Chirag Paswan from Hajipur seat in Bihar. Today this petition was listed before the bench of Justice Vikas Mahajan. The court asked the petitioner that the jurisdiction to hear this petition is Patna High Court, so how have you filed a petition in Delhi High Court. The High Court ordered the next hearing on this question on August 28.
The petitioner woman had filed a case of sexual harassment against Chirag Paswan and Prince Raj and several others in 2021. An FIR has also been registered in Delhi regarding this matter. This case is pending in Rouse Avenue Court. The petition states that Chirag Paswan did not mention this case while giving information about his criminal history in the election affidavit filed during his nomination. The petition states that by hiding this matter in the election affidavit, Chirag Paswan has violated Section 125A of the Representation of the People Act.
During the hearing, lawyer Siddhant Kumar, appearing on behalf of the Election Commission, said that according to the Representation of People Act, this petition is not admissible for hearing, because the elections have been held in Bihar. During the hearing, ASG Chetan Sharma, appearing on behalf of the Central Government, said that only a voter or candidate of the constituency can file an election petition. This petition does not fall into any category. After that, the petitioner's lawyer demanded time to present arguments on this question as well as the question of jurisdiction, after which the court adjourned the hearing till August 28.
