Medical college's petition rejected, challenge given to reduce MBBS seats

Jaipur, 6 November (HS). Rajasthan High Court has rejected the petition filed against reducing the MBBS seats of the Medical College after the lack of resources was found in the surprise check. A single bench of Justice Sameer Jain gave this order while hearing the petition of Indian Mission of Medical Sciences Society, Kota and Sudha Medical College, Jhalawar. The court said that the Dean of the Medical College had accepted the establishment of the college with admission to a hundred seats during the decision of the appeal. In such a situation, the petitioner is bound by the principle of estoppel.

The petition said that the petitioner had applied for medical college. On this, the Medical Education Department, after preliminary investigation, issued a letter on March 24, 2023, granting permission to the petitioner to establish a medical college with a capacity of 150 seats for three academic sessions. After this, the petitioner completed all the formalities and applied for affiliation and recognition from Rajasthan University of Health Sciences. RUHS also gave him permission on April 9, 2023. The petition said that the petitioner applied for permission before the National Medical Commission to establish the college. On this, the National Medical Evaluation and Rating Board gave a notice to the petitioner on April 3, citing some shortcomings. To which the petitioner replied. The petition said that the board conducted a surprise inspection and reduced the number of seats from 150 to 100 on July 4 citing lack of resources and faculty in the institute. This action was challenged by the petitioner by filing a first appeal and later a second appeal before the competent authority. After both these appeals were rejected, a petition was filed in the High Court seeking permission for admission to 150 seats. Opposing this, advocate RD Rastogi, appearing for the board, said that due to lack of resources and faculty in the medical college, admission was allowed only on 100 seats. Apart from this, during the hearing of the appeal, the Dean of the petitioner had accepted the establishment of the college with admission on 100 seats. After hearing the arguments of both the sides, the court rejected the petition.
