Maternity leave law is to provide benefits, not to control population: High Court

Mumbai: The Bombay High Court on Friday set aside an Airports Authority of India (AAI) order denying maturity leave to a female employee, saying motherhood is a natural phenomenon and employers should be compassionate and patient with female employees. Should be dealt with. The woman was refused leave on the grounds that she already had two children.

The court said that it is necessary for a woman who works for a living to be treated with dignity and respect at her workplace. No matter the duty, women should be helped in their rights. In 2014, the court quashed the order given by AAI, Western Region Headquarters.

The petitioner woman was earlier married to an AAI employee and after his death she was given compassionate employment. The woman said in the application that she had a child from her previous marriage but after her husband's death, she remarried and has two children.

The woman did not take maternity leave for the birth of a child from her first marriage and sought benefits for the birth of her third child which was rejected. The second child was born before his appointment.

The purpose of the law is to provide benefits of maternity leave and not to control population. For a female employee to avail the benefit twice, a condition has been imposed that two children should be alive. The court said that care has to be taken that the organization does not remain without an employee more than twice. The court said that the rules should be interpreted liberally.
