Madras High Court: The Madras High Court on Wednesday strongly criticized the Tamil Nadu Police for removing the statue of Bharat Mata from the Bharatiya Janata Party office. Now the High Court has ordered the state government to return the statue to the BJP, saying it is not the job of the state to regulate activities inside private property.

Justice Anand Venkatesh of the Madurai bench said, I have no doubt that the administration has arbitrarily removed the statue of Bharat Mata from private property. It is possible that he may have done this due to pressure from somewhere else. This entire action is condemnable and should never happen in future. We live in a welfare state governed by the rule of law.
The matter started when the Tamil Nadu government issued a notice to the BJP citing the High Court order in 2022. It has been said in the order that no new statue of any leader can be installed. The post which poses a risk of public disturbance should be transferred to another place. The state government said that because no response was received to the notice sent to BJP. Therefore, for the purpose of maintaining social peace, the statue of Bharat Mata was removed and now this statue is kept safe in the office of the Revenue Department.
BJP accused DMK government
BJP argued in the court that the statue of Bharat Mata has been installed in our office as a symbol of India. BJP alleges that the ruling DMK government in Tamil Nadu ordered the police to illegally enter the BJP office and remove the statue.
Importance of Bharat Mata statue
The court described this matter as important and said that the question is what is the limit of the right to freedom of expression on private property? Justice Venkatesh said, ‘No person acting with his understanding and discretion can say that expression of love and patriotism for his country can jeopardize the interests of the state or society.’ He further said, ‘Planting the idol of Bharat Mata in one’s garden is a symbol of personal faith. It invites reflection on the ideals of freedom, courage and cultural identity.’
