The Madhya Pradesh High Court has given an important verdict in a case related to the marriage of a Muslim man and a Hindu woman. The High Court held that marriage between a Muslim man and a Hindu woman is not valid under Muslim Personal Law. The court rejected the petition seeking police protection for the registration of inter-religious marriage under the Special Marriage Act, 1954. According to the Bar and Bench report, Justice Gurpal Singh Ahluwalia said that even if a Muslim man and a Hindu woman have registered their marriage under the Special Marriage Act, the marriage will be considered irregular under Muslim Personal Law. The High Court said in its order on May 27, 'According to Muslim law, if a Muslim man marries a woman who is an idol worshipper and fire worshipper, then that marriage will not be considered valid.'

The woman's family protests

The application by a Muslim man and a Hindu woman sought police protection for marriage registration. The application said that the woman's family was against inter-religious marriage. Both said that the man and the woman have decided to continue following their respective religions even after marriage. The application expressed apprehension that the society might shun the woman if the marriage took place. In this case, the family claimed that the woman had taken jewellery from the house before marrying her Muslim partner. The petition requested that the couple be given police protection to appear before the officer while going for marriage registration under the Special Marriage Act.
