The government has intensified efforts to curb financial frauds committed through mobile phones. Unsolicited business calls will soon become an unfair business practice. Which will be brought under the purview of legal provisions. Those making such unsolicited commercial calls or messages will be held criminally liable under the Consumer Protection Act. Guidelines in this regard will be prepared by the Department of Consumer Affairs in the next few months. Under these guidelines, the legal liability of telemarketers and their companies such as banks, real estate or any other consumer business will be determined in case of calling any user or sending them promotional or commercial advertising messages.

Unnecessary or unsolicited commercial communications would amount to deceptive and unfair trade practice under provisions 2(28) and 2(47) of the Consumer Protection Act, 2019. Under the guidelines, a separate list will be prepared as to which types of calls fall in the category of unwanted or unnecessary calls. A definition of such calls will also be made. The focus now is to ensure that all promotional and transactional calls are made only through official channels, along with fixing accountability for such calls. If this is not followed or such calls are not routed through proper channel, legal action will be taken as per the Consumer Affairs Act.

It is noteworthy that recently a report had come out, in which it was clearly stated that when Lok Sabha elections are going on in the country, political parties will not be able to call users without asking for votes for their party or candidate. From the next election.
