Laws to stop pollution are of no use: Supreme Court

New Delhi: Pollution has started increasing once again in Delhi-NCR. The amount of poison in the air is gradually increasing. The Supreme Court has once again criticized the Central, Punjab and Haryana governments on pollution laws and said that these laws are of no use.

The court held that the provisions of the CAQM Act relating to penalty for stubble burning were not implemented. The court criticized the Center for making environmental laws useless.

The Supreme Court said that it is the fundamental right of everyone to live in a clean and pollution-free environment and it is the duty of the Central and State Governments to maintain the rights of the citizens.

A bench of Justices Abhay S Oka, Ahsanuddin Amanullah and Augustine George Masih said the Commission for Air Quality Management in NCR and Adjoining Areas Act, 2021 has been implemented without creating the necessary mechanism .

Justice Abhay Oka has said that the Government of India has not made any system. Environmental protection laws have become impotent. You have amended Section 15 and imposed fine instead of punishment and the necessary procedure for imposing fine is not being followed.

Additional Solicitor General Aishwarya Modi, appearing for the central government, said that Section 15 of the CQM Act, which provides for penalty for burning stubble, will be effectively implemented.
