Indian justice system badly plagued by frivolous litigation: High Court

Prayagraj, 23 February (HS). Allahabad High Court, while accepting the criminal petition against three professors of Allahabad University, also made a serious comment on the Indian justice system. The Court said that the Indian judicial system is badly plagued by frivolous litigation. There is a need to develop methods and means to stop this.

The Court said that for many centuries the Indian society nurtured the two basic values ​​of life i.e. truth and non-violence. Mahavira, Gautam Buddha and Mahatma Gandhi guided people to adopt these values ​​in their daily lives. Truth was an integral part of the justice-delivery system that prevailed in the pre-independence era and people took pride in speaking the truth in the courts regardless of the consequences.

However, our value system underwent drastic changes in the post-independence period. Materialism has eroded the old ethos and people are not hesitating to resort to lies, misrepresentation and suppression of facts by getting involved in litigation for personal gain. The court said that the Supreme Court and other high courts of the country have given concrete decisions many times. The present case is also a complete abuse of the process of law.

The complainant, in order to take personal vendetta against the professors, had tried to implicate him and his associates by filing false and frivolous cases. Whenever the head of the department asked her to teach properly and attend classes regularly, she would file a complaint against him. This is not the first case that has happened. The complainant, who is a well-educated woman, knows the provisions of the law very well and she was misusing the provisions of the law for personal gain.

The complaint filed by the complainant was nothing but a pure abuse of the process of law. The actions of the complainant tarnished the public image of the professors. He had to wander from door to door to save himself.
