Judicial independence means giving decisions free not only from the executive (government) but also from various pressures and influence of interest groups.
DY Chandrachud explained the meaning of judicial independence
Explaining the impartiality and transparency of the judiciary, the Chief Justice said, 'Traditionally, judicial independence was defined as independence from the executive. Independence of the judiciary still means freedom from government interference. But this is not the only thing regarding judicial independence.
In this regard he further said, 'Now the situation has changed. There has been a change in society especially after the advent of social media. You must have seen pressure groups that try to put pressure on the courts to take favorable decisions and use electronic media for this. This pressure group creates such an environment that the judiciary is considered to be working independently only if the decision is in their favor. If the decision does not please them, the judiciary will not be considered independent.
Judges are guided only by law and Constitution: CJI
DY Chandrachud expressed grief over the matter, saying, 'To be independent, a judge must have the freedom to decide whether to listen to his conscience or not. And there is no doubt that the conscience of the judge is guided by the law and the Constitution. When the judgment comes against the government and the electoral bond scheme is cancelled, the judiciary is very independent, but if the judgment goes in favor of the government, the judiciary is no longer independent… This is not my definition of independence.
