This privilege is granted to the President, Vice President, Governors, Deputy Governors, Heads of Indian Missions, Prime Minister, Cabinet Ministers, State Ministers, Chief Ministers, Speaker of Lok Sabha, Deputy Speaker of Lok Sabha, Deputy Speaker of Rajya Sabha, Heads of Legislative Councils of States, Speakers of Legislative Assemblies of States and Union Territories, Deputy Speakers of Legislative Assemblies of States and Union Territories, Chief Justice of India, Judges of the Supreme Court and Chief Justices of High Courts.

Although citizens have the freedom to hoist the tricolor at home and carry the flag in their hands, hoisting the flag on private vehicles is considered a legal offense. If anyone is found guilty in this regard, action can be taken against him under the Prevention of Defamation of National Honor Act, 1971. The Act states that a person insulting the national flag, the Constitution and the national anthem can be imprisoned for up to 3 years or fined or both.
