Flag code: Every year you must have seen that on the occasion of Independence Day and Republic Day, people put the national flag on their bikes or cars in a spirit of patriotism. But not everyone is allowed to do so. According to the Indian Flag Code, 2002, only a few people have the legal right to display the tricolor on their vehicles.
Who has the right to put the tricolour on vehicles?
According to the National Flag Code, there are some rules for hoisting the tricolour such as whenever the tricolour is hoisted, the saffron colour should be on top. Also, it should not be torn or worn out.
According to Article 3.44 of the Flag Code of India, 2002, in the matter of flying the national flag on vehicles, the privilege of flying the national flag on motor cars is reserved only for the President, Vice-President, Governors and Lieutenant-Governor, Chief of the Armed Forces, Cabinet Ministers, Ministers of State and Deputy Ministers of the Union, Chief Minister and Cabinet Ministers of a State or a Union Territory, Speaker of the Lok Sabha, Speaker of the Rajya Sabha, Deputy Speaker of the Lok Sabha, Speaker of State Legislative Councils, Speakers of State and Union Territories, Deputy Speakers of State Legislative Assembly, Deputy Speakers of State Legislative Councils, Chief Justice of India, Judges of the Supreme Court, Chief Justice of a High Court, Judges of a High Court.
What is the punishment for breaking the rules?
Citizens have the freedom to hoist the tricolor at home or carry the flag in their hands. But hoisting the national flag on private vehicles is a crime. If a person is found guilty in this, he can be prosecuted under the Prevention of Insults to National Honour Act, 1971. According to this, insulting the national symbols of India such as the national flag, the Constitution and the national anthem can result in a jail term of up to 3 years or a fine or both.
Keep these things in mind while hoisting the flag at home
According to the rules, any member of any public/private organisation or educational institution can hoist the national flag on any day and on any occasion. But the important thing is that whenever the national flag is hoisted, it should be given full respect.
Does the national flag have to be lowered at night?
Earlier, it was allowed to hoist the national flag only from sunrise to sunset, but in 2022, the government amended this rule and removed the time restriction. Now permission has been given to hoist the national flag on people's homes at night
By amending the flag code, the ban on hoisting flags made of polyester cloth has been removed. Apart from this, the national flag can also be made of cotton/polyester/wool/silk/khadi. Hand-woven or machine-made national flags can also be used.
