If the selection process starts earlier then the benefit of reservation cannot be given: High Court


Prayagraj, March 01 (HS). Allahabad High Court said that when the selection process has already started then the benefit of reservation cannot be given. Same is the case with 69000 assistant teacher recruitment in UP. The government order to provide the benefit of 10 percent reservation to economically weaker sections was implemented by the UP government in 2020. Whereas the selection process had already started. The court refused to grant relief to the petitioners.

Justice Saurabh Shyam Shamsheri has given this order by simultaneously hearing 25 petitions including Shivam Pandey and dismissing them. In the petitions filed by the petitioners, there was a demand to give the benefit of 10 percent reservation to the economically weaker general category candidates in the recruitment matter. On behalf of the petitioners, it was said that the recruitment process was started from 16 May 2019. Whereas, the Central Government implemented this Act on 12 January 2019 itself.

Therefore, they should get its benefit. The court said that the UP government adopted this Act in October 2020. Before that he had not implemented any such act. Therefore, there is any legal basis in the argument of the petitioners. Therefore, all the petitions are dismissed.
