New Delhi: The Supreme Court took cognizance of the issue of removal of women judges by Suomoto, while taking serious note of the fact that a woman judge was removed from service despite facing personal physical problems. Supreme Court Justice BV Nagarathna said that if a woman is suffering physically and mentally then you cannot say that she is slow in work, send her home. Have the same standards for male judges and judicial officers and see what happens. If men also had menstruation, they would have understood the condition of women.
At least six civil women judges in the country were removed from service, which the Supreme Court took cognizance of and Suomoto heard. Supreme Court Justice BV Nagarathna and Justice N Ketishwar Singh sought clarification from the Madhya Pradesh High Court on the criteria considered for removing these judges. Meanwhile, Justice BV Nagarathna said that I have no hesitation in saying that I hope that the standards considered for women judges will be applicable to male judges also.
Supreme Justice Nagarathna said that a civil woman judge had suffered a miscarriage, her brother was suffering from cancer. At a time when the Corona pandemic was widespread, the work of this woman judge was judged only by how many cases were disposed of. During this period, the mental and physical pain that this woman judge had to endure was not considered. If men also had periods, they would have understood the condition of women. It is very easy to say dismiss the case and go home. The Supreme Civil Judge was considering the case of Aditi Kumar Sharma and Sarita Chaudhary.
Whose recruitment was done during the year 2017-18. Madhya Pradesh High Court, in its cover letter submitted to the Supreme Court, said that the decision to remove these judges from service cannot be reversed. Civil Judge Aditi Sharma’s performance as a judge was downgraded from very good and good to average and poor in 2019-20. In the year 2022 they had 1500 cases and the disposal rate was less than 200. The judge told the High Court that there was an abortion in the year 2021, during which my brother got cancer. Which had a mental impact. However, the High Court dismissed him from service without considering these arguments. At present, the Supreme Court took cognizance of this decision of the High Court and the government through Suomoto and asked the High Court for criteria for action against women judges. Now the further hearing of this case will be held on December 12.
