Amidst this situation, the Supreme Court has raised an important question. During the hearing of a case, the Supreme Court said that if we start sending people to jail for commenting on YouTube before the elections, then how many people will go to jail?
A YouTuber in Tamil Nadu criticized the government, due to which he was arrested. YouTuber A was arrested for making objectionable comments about Tamil Nadu Chief Minister MK Stalin. While his appeal was being heard, lawyer Mukul Rohatgi, appearing for the Tamil Nadu government, asked the Supreme Court bench of Justice Abhay S Oka and Justice Ujjwal Bhuyan that if the arrest of YouTube critics is started before the elections, then how many People will go to jail. , The Supreme Court said that in this case we do not think that the petitioner YouTuber has misused the freedom to which he was entitled. Rohatgi later appealed that even if bail is granted, conditions should be imposed on the YouTuber that he will not make such comments again. However, the Supreme Court refused to impose any such conditions and granted bail to the petitioner. Two complaints were received against the YouTuber in 2022 and 2023. The Supreme Court asked who would decide whether a comment is controversial or not?
