High Court’s decision to cancel the FIR registered against Nishikant Dubey and Manoj Tiwari challenged in the Supreme Court.

New Delhi, 27 November (HIST). The Jharkhand government has challenged in the Supreme Court the decision of the High Court to cancel the FIR registered against BJP MPs Nishikant Dubey and Manoj Tiwari for pressurizing Deoghar airport to take off in March 2023. A bench headed by Justice AS Oka directed the Jharkhand government to file a copy of the order stating that permission is not required from the concerned authority to continue the investigation. The next hearing of the case will be on December 18.

During the hearing, the Jharkhand government said that there is no need to take permission from the concerned authority to continue the investigation in this case. Countering this argument of the Jharkhand government, the lawyer appearing for Nishikant Dubey and Manoj Tiwari said that to continue the investigation in this case, it is necessary to take permission from the concerned authority and on this basis the High Court had given the decision.

In fact, on March 13, 2023, the Jharkhand High Court had canceled the FIR registered against Nishikant Dubey, Manoj Tiwari and other accused in the case of pressurizing them to take a flight in the evening. This order of the High Court has been challenged by the Jharkhand government in the Supreme Court. Nishikant Dubey and Manoj Tiwari are accused of violating security rules at Deoghar airport. He had put pressure on ATC to allow the private plane to take off in the evening.
