High Court stays order to cancel seats | News India

Jodhpur, 24 September (HS). While hearing a petition, Justice Dinesh Mehta of Rajasthan High Court has passed an order to enable a girl student to continue her studies smoothly at Government Medical College, Churu.

In fact, Mudita Meena, a resident of Chittorgarh, appeared in the National Entrance Test (NEET) in the year 2024 and secured fifty-five percent marks. After her counseling and document verification, she was temporarily allotted Government Medical College, Churu by order dated August 30 and pursuant to this order, she also deposited the prescribed fee. After that, she was verbally informed by the department that since her name in the mark sheet of secondary education and higher secondary education is Mudita Malavat and her name in her birth certificate, Aadhaar card, voter card, caste certificate and ration card is Mudita Meena, therefore her seat allotment is cancelled.

Distressed by this act of the department, the student presented a writ petition before the High Court through her advocate Pramod Bohra. The advocate told the High Court that no document has been hidden by the applicant. She has applied for NEET exam in the name of Mudita Meena because in all her documents the name is Mudita Meena, only in the mark sheet of tenth and twelfth her name is Mudita Malavat and Malavat is her gotra which comes in the Meena caste, but the department verbally cancelled her admission, which is unfair. Along with this, she presented an affidavit in this regard before the organizers of NEET exam 2024 that Mudita Meena and Malavat are the same. There is no difference between them and if there is any kind of dispute in future, then she herself will be responsible for it. She has also requested the Board of Secondary Education, Ajmer to replace Malavat with Meena in the caste, which is currently in progress. The lawyer appearing on behalf of the central agency conducting the NEET exam argued that whoever has participated in NEET 2024 was given adequate opportunity to correct the error but it was not availed. Therefore, now he is not entitled to get any kind of benefit. After hearing, the High Court accepted the writ petition of Mudita Meena for interim consideration and issued notices to the Central Government and State Government, the organizers of NEET Exam 2024, and passed an order to the Principal of Government Medical College Churu to conduct uninterrupted study under the temporary allotment letter of the applicant and not to release his result without the order of the court. Along with this, the exemption to get the name amended in time was also given.
