Prayagraj, March 13 (HS). The Allahabad High Court has refused to issue directions to the Bar Council of India and the Uttar Pradesh Bar Council of India on a PIL to send certificates of practice to the homes of advocates appearing for the All India Bar Examination (AIBE) within thirty days. .
The court said that the PIL has been filed on the basis of viral reports in social media of 2019. There is a lack of empirical data. Therefore, the petition deserves to be dismissed. This order has been given by the division bench of Chief Justice Arun Bhansali and Justice Vikas Wednesday while rejecting the petition of Prateek Shukla.
However, the court also said that the petition has been filed for good purposes. The petition points out that malpractices have taken place at the centers where the AIBE exam is conducted and the exam takers are involved in it. It appears that the petitioner had filed a similar petition in the year 2021, which he had withdrawn and after a lapse of almost three years, filed the same petition again. No changes were made in the petition.
In this matter, a PIL was filed by the petitioner demanding instructions to the Bar Council of India and the UP Bar Council of India on two points. The first demand was that CCTV cameras should be installed at the centers where AIBE is being conducted and practice certificates should be sent to the homes of those appearing in the examination within thirty days. It was said that AIBE is being organized every year but problems are coming to the fore every year. Because of this the results are withheld.
