New Delhi, 23 February (HS). The Delhi High Court has dismissed a petition filed against the Delhi Police for not granting permission to protest at Jantar Mantar regarding alleged obstacles in the implementation of the One Time Settlement Scheme of Delhi Jal Board. The bench of Justice Subramaniam Prasad said that how can a ruling party seek permission for the demonstration, when prohibitory orders have been imposed due to the farmers' protest.
During the hearing, advocate Rajat Bhardwaj appearing for the Aam Aadmi Party said that on February 17, the Aam Aadmi Party had written a letter to the Delhi Police and the concerned DCP demanding permission for the demonstration at Jantar Mantar. It was said in the letter that apart from Delhi Chief Minister Arvind Kejriwal, ministers and Aam Aadmi Party MLAs, about eight hundred people will gather in the protest at Jantar Mantar. In response to Aam Aadmi Party's letter, Delhi Police wrongly and arbitrarily rejected the petitioner's request to hold a peaceful protest at Jantar Mantar on 23 February.
It was said in the petition that peaceful protest at Jantar Mantar is a fundamental right under Article 19(1)(b) of the Constitution. This is an integral part of democracy. The court asked the lawyer appearing for Delhi Police to take instructions in this regard and inform the court. The court was listing the next hearing of this case for February 26. Then the Aam Aadmi Party was asked to come with instructions within an hour. But after that Aam Aadmi Party sought permission to withdraw the petition, after which the court rejected the petition and allowed the petition to be withdrawn.
