New Delhi, 06 August (HS). The Delhi High Court has refused to give any order on the demand to cancel the recognition of Aam Aadmi Party for organizing Ganesh Chaturthi in 2021. The bench headed by Acting Chief Justice Manmohan said that cancelling the recognition of a party is a serious matter and it cannot be done like this.
The High Court told the petitioner that many governments issue advertisements giving messages to citizens during various religious events. In such a situation, will you say that this is a violation of the Constitution by citing secularism in the Constitution. The High Court said that the state government is not telling anyone to adopt Hinduism or Buddhism. The state government is only saying that you should celebrate festivals. On the demand to register an FIR, the High Court said that instead of filing a PIL, it is better to take another appropriate step to register an FIR.
The petition was filed by lawyer Manohar Lal Sharma. It was said in the petition that organizing Ganesh Chaturthi by Aam Aadmi Party is a violation of the principle of secularism of the Constitution.
Let us tell you that on 20 September 2021, the High Court had issued a notice to the Center, Delhi Government and Election Commission on the petition of Manohar Lal Sharma. The petition states that India is a secular country and no government can organize any religious event. The petition mentions the decision of SR Bommai. The petition states that the Delhi government organized and broadcast Ganesh Puja in 2021. This event was organized jointly by the Delhi Government and the Aam Aadmi Party. Doing so is a blatant violation of the Constitution. The petition seeks the cancellation of the recognition of the Aam Aadmi Party as a political party.
