Prayagraj, 21 May (HS). The Allahabad High Court has legalized the state government's policy of merging primary and upper primary council schools running on the same campus.
The court said that this is a policy decision of the government and no fact could be presented that this scheme, which has been running for the last five years, is in any way harmful for the students. The merger mandate was challenged in the petition.
The court said that a policy decision cannot be canceled on the basis of a possibility. Justice Saurabh Shyam Shamsheri has given this order while rejecting several other petitions including that of Hina Khaliq. The court has directed the government to form a committee and resolve the problems of the teachers, so that no one's legal right is violated in getting promotion to the post of headmaster. In these petitions, the government order of 22 November 2018 was challenged, in which the decision to merge primary and upper primary schools running on the same campus was taken.
It was arranged that the senior most teacher of these schools would be the headmaster and he would handle all the financial and administrative work. Both the schools will be like one unit. The petitioners said that this mandate will affect the future of those teachers who are going to be headmasters in primary or upper primary. Who was already the headmaster and now became junior.
The court said that no such argument was presented that this decision has been taken by the government without any basis and it is not in the interest of the students. The scheme has been running for the last five years and there was no complaint that any senior teacher was not given charge. The court said that this decision is in the interest of the students and with this all the students will be able to benefit from the experience of upper primary teachers. The future of some teachers is likely to be affected. Especially, when it is in the interest of the students.
The court has directed the state government to form a committee and properly comply with the government order. Especially paragraph 10 in which it is said that after the merger, the posts of teachers and headmasters already created will remain the same.
The High Court has directed the state government to form a committee to hear the real problems of the teachers and solve them after talking to all the parties.
