Hearing postponed on petition challenging exchange of land in Gyanvapi case

Varanasi, 11 October (Hindustan Reporter). The hearing on the petition challenging the three-year-old land exchange in the Gyanvapi case was postponed on Friday. The court of Civil Judge CD Hitesh Aggarwal has fixed October 18 as the next date of hearing in this case.

Advocate Nityanand Rai, former General Secretary of the Plaintiff Banaras Bar, terming the exchange of land as wrong, has demanded through a petition to transfer the entire land of Kashi Vishwanath Corridor in the name of Baba Vishwanath. The notice sent by the plaintiff has been received by Uttar Pradesh Government, District Magistrate Varanasi and Chief Executive Officer Shri Kashi Vishwanath Temple Trust. But none of the defendants appeared in the court nor filed an answer sheet. Plaintiff advocate Nityanand Rai said that the motion of no adverse was passed due to the closure of the collectorate on Mahanavami and Vijayadashami festivals. In such a situation, the hearing will now be held on October 18.

He said that this new case in the Gyanvapi case is special in that it has challenged the exchange of land between the trusts through Anjuman arrangements. The claim states that the plaintiff is a devout Hindu. Declaring itself the owner of plot number 8276, Anjuman Arrangement has taken over the building number C.K. purchased by the Uttar Pradesh government. Swapped with 38/12,13. Anjuman said CK 31/19 was situated at plot number 8276. But no proof of this was given. Taking advantage of the haste in constructing the corridor, Anjuman hatched a conspiracy to exchange the corridor. In a hurry, the transfer agreement between Uttar Pradesh Government and Anjuman was done at the place of Deputy Registrar II on July 10, 2021, which went wrong.

In the exchange deed, there is mention of Kashi Vishwanath Temple in the east, west, north and south boundaries of building number C 31/19. The court has been requested to declare the exchange document dated 10.07.2021 void. And the ownership of Shri Kashi Vishwanath Temple should be declared on all the states falling within the Vishwanath Temple Parkota, 8276, 9130, 9131, 9132, 9133, 9134, 9135 Mauza City Khas, Pargana Dehat Amanat.
