Nainital, September 17 (HS). After hearing the PIL filed by residents of Nepali origin regarding encroachment on government land around Nainital and occupation by preparing Indian documents in a wrong manner, the High Court has directed the state government to file a reply within four weeks. The court has also asked to tell what action the government has taken on this.

The case was heard before the division bench of Chief Justice Ritu Bahri and Justice Rakesh Thapliyal. According to the case, Pawan Jatav, a resident of Nainital, had filed a PIL in the High Court saying that for the past several years, people from Nepal have occupied government and Nazul land near Bajun Chowk in Tok Bay of Khurpatal village of Nainital city and Nainital district and have constructed residential buildings. These people have neither applied for citizenship nor have acquired Indian citizenship in any way and are taking advantage of government schemes by illegally making documents here like Aadhaar card, voter ID card, driving license, permanent residence certificate, ration card, health services card. Along with this, they have illegally obtained water and electricity connections etc. by making voter list, PAN card, Aadhaar card and registering names in the voter list. In this regard, he complained about it several times to the district administration and high officials of the state government, but no solution was found to his complaint. Not only this, these people are even smuggling drugs. Due to this, the youth here are getting ruined. The petitioner requested the court to put a stop to such illegal activities. Instructions should be given to take departmental and punitive action against the officers who have issued these certificates to them.
