HC reprimands husband who calls wife second hand, will have to pay Rs 3 crore compensation

The accused of assaulting his wife will now have to pay compensation worth crores of rupees and maintenance allowance of Rs 1.5 lakh per month to his wife. The Bombay High Court upheld the trial court's order, refusing to grant any relief to the accused in a domestic violence case. The court said that this amount is being recovered not only for causing physical injury but also for causing mental torture and emotional torture. The couple married in January 1994 and settled in the US. Both of them had also organized a wedding in America. The couple returned to India in 2005. They started living in a house which was owned by both of them. In 2008, the wife started living with her mother and the husband returned to America in 2014.

In July 2017, the woman filed a case in the Metropolitan Court. The woman alleges that her husband called her second hand during the honeymoon because she had remarried after her earlier engagement broke.

Order to give compensation of Rs 3 crore to husband

The trial court, while delivering its verdict in the case in January 2023, said that the woman was a victim of domestic violence by her husband. The husband was ordered to pay compensation of Rs 3 crore. The court asked the husband to buy a house with 1,000 square feet carpet area in Dadar area or pay a house rent of Rs 75,000 per month. The court also ordered the husband to return all his jewelery and pay him a maintenance allowance of Rs 1.5 lakh per month.
