Government’s big bet in Supreme Court on recruitment of 69 thousand teachers: Jobs of 67,867 teachers secured, 8,270 new candidates get a chance

In the much talked about 69 thousand assistant teacher recruitment case of Uttar Pradesh, the state government has filed an important and detailed affidavit before the Supreme Court. The government has clarified its stand in the apex court saying that there will be no adverse impact on the jobs of 67,867 assistant teachers working since the year 2020 and their services will be completely safe. Along with this, efforts will be made to appoint new candidates who are found eligible in the revised merit list prepared as per the instructions of Allahabad High Court on the basis of available vacant posts.

This systematic decision will be limited to this recruitment only.

The state government has assured the Supreme Court that this proposed system will be applicable only for the recruitment process of 69 thousand assistant teachers. This will not be considered as an example or legal precedent for any other future government recruitment process. Along with this, the government has assured that whatever final decision the Supreme Court takes in this matter, its instructions will be completely followed.

Revised list of 8,270 candidates submitted to the court

Along with its affidavit, the state government has also presented a revised list of 8,270 candidates before the Supreme Court. This includes those candidates who are not currently in service. There are 3,324 Other Backward Class (OBC) candidates in this list. The government also clarified that in the previously released list, there were 4,926 candidates who had not joined the charge despite the appointment letters being issued. It has also been proposed to accommodate new eligible candidates on the basis of such vacant posts.

Complete sequence of the controversy that started from 2018

This recruitment process started in December 2018, while the Assistant Teacher Recruitment Examination (ATRE) was conducted in January 2019. After the examination, the cut-off was fixed at 65 percent for the general category and 60 percent for the reserved category, which was later declared legally valid by the Supreme Court. After this, in June 2020, 67,867 candidates were appointed, while some posts of Scheduled Tribe (ST) remained vacant due to non-availability of qualified candidates.

How did the reservation issue reach from the High Court to the Supreme Court?

Controversy arose when petitions were filed regarding adjustment of meritorious candidates of reserved category (MRC) in the general category and correct compliance of reservation rules. In March 2023, the single bench of the High Court had given instructions to amend the selection list, while in August 2024, the Division Bench ordered to prepare a fresh merit list for the entire recruitment. After this, in September 2024, the Supreme Court had put an interim stay on this order of the Division Bench. Now, with this new solution introduced by the state government, along with saving the jobs of the already working teachers, the hope of getting big relief to the new eligible candidates who have been struggling for years has also increased.
