You may not be a police officer or a lawyer. But you must know the meaning of sections like 302, 307, 376 of the Indian Penal Code i.e. IPC. The existing various sections of murder, attempt to murder, rape will now be removed from July 1. The government is going to implement a new law. The Indian Penal Code, the Indian Criminal Procedure Code will be abolished from July 1. In its place, the Indian Justice Code (BNS), the Indian Civil Security Code (BNSS) will be implemented.
Police can use handcuffs in cases where the sentence is more than seven years
From the police station to the court, the law made by the British in 1860, IPC, was being implemented. Reports were filed regarding this and hearings were held in the court. According to any FIR, the earliest Indian Penal Code was written in 1860. Now from July 1, the Indian Judicial Code will be written in its place in the FIR. There are 511 sections in the IPC and 358 sections in the BNS.
Forensic report is mandatory in this case
Section 395 of robbery will be replaced by 310 (2). Till now, Section 307 was applicable for attempt to murder. But now the report will be filed under Section 109. Cases of fraud will be registered under Section 316 instead of Section 420. Similarly, all sections of crime have also been amended. Now the policemen are reading it. Under the new law, forensic report will be mandatory in cases with punishment of more than seven years. Along with this, till now there was no provision of handcuffing the accused. Now the police will be able to use handcuffs in cases with punishment of more than seven years.
A workshop will also be organised for lawyers
An official of Bareilly Bar Association said that when the new law comes into force from July 1, advocates will also have to face many problems. The problem for advocates is that the hearing of old cases will be done under the old sections. The provision of punishment will also remain the same as before. In such a situation, the responsibility of the lawyers has increased the most. Workshops will be required to give information to the lawyers under the new law. A workshop will be organized soon after talking to the bar officials.
