False allegation of rape: A court in Bareilly, Uttar Pradesh, has sentenced the complainant girl to the same punishment for making a false complaint of rape as the accused youth had to face due to this false complaint. On the false complaint of the girl, the young man was sentenced to four years and six months' imprisonment.
The court gave the same punishment for filing a false complaint
Without any reason, such punishment had to be given only on the basis of a false complaint. Due to which the court sentenced the complainant woman to the same punishment and also imposed a fine of Rs 5.9 lakh. This amount of fine will have to be paid to the victim youth, who had to serve jail sentence on false charges.
Made false complaint of kidnapping and rape at the behest of mother
In 2018, when the girl was 15 years old, she told the court that Ajay Kumar alias Rathev had raped her. A complaint of kidnapping and rape was filed against Ajay Kumar on the request of the girl's mother.
Action was taken against the girl under section 195 of CrPC
The girl also claimed rape in front of the magistrate. However, when cross-examined the girl walked back and told the court that I had lied before the magistrate that Ajay had not raped me. In view of this statement, the court later took action against the girl under Section 195 of CrPC for false complaint and statement.
An innocent man was jailed for four years due to a false complaint
Also, Bareilly Court said that the case clearly shows that no incident of rape took place, as Ajay had to spend four years in jail due to the girl's false complaint. However, now the girl herself is saying that Ajay is innocent. It is clear from the case that the girl has misused the Women's Protection Act. Due to which men's rights have been violated.
Women who are the real victims also have to bear the brunt of false complaints. Which is a very serious situation for the society. Using the police and courts to achieve one's goal is not acceptable.
